Terms of Business

This document sets out the terms of business on which Fynda.co.uk will provide services to you. Please read this document carefully and contact us if you have any queries regarding anything in this document which you do not understand. At Fynda.co.uk we are committed to providing a high quality of service to our customers.

What is the role of Fynda.co.uk?

Fynda.co.uk is not a credit broker or a credit intermediary or car dealer. This means that Fynda.co.uk will not arrange finance for you but introduce you to one of our pre-selected car dealers or car finance specialists. In arranging finance, they do not conduct a market appraisal and they do not give any assurance or undertaking that the terms offered are the most competitive on the market. Whilst they will do there best to source an offer of finance for you, all finance is subject to status and terms and conditions will apply. Whether you are offered finance and upon what terms will depend on a variety of factors including your occupation, income, credit rating and creditworthiness.

In order to make a finance application, they will need to take some details from you. They also need your consent to pass on your information to our panel of lenders so that they can assess your finance application. In order to be considered for finance, They may want to consult a credit reference agency. This may leave a footprint on your credit file. But they will always ask your permission to do so. If you are declined for finance then they will provide you with details of the credit reference agency (“CRA”) that they and/or any of there lenders consulted with. You are then free to make further enquires with the CRA should you wish to do so. If you want to place a restriction on the number of credit searches that are undertaken on you then please make this clear to the dealer at the outset so that they can limit our search.

In relation to finance, Fynda.co.uk does not acts as agent of the lenders. We are not in a position to give you independent advice on financial products. The dealer will however provide you with oral and written information so that you can make your own informed purchasing decision. You will be given time to read all the documentation provided to you prior to signing and given time to ask questions which they will do our best to answer for you.

Regulatory Information

All dealers and car finance specialists must adhere to the requirements of the s Authorised & Regulated by the Financial Conduct Authority (FCA). They must all have a firm reference number that you and you can check these details on the FCA register by visiting the FCA’s website www.fca.org.uk or by contacting the FCA on 0300 500 0597.

What Financial Products does the Dealer or Car Finance Specialist offer?

If your application for finance is approved, we will provide you with one specific offer of finance from one of our external lenders.

The dealer or car finance specialist is able to arrange Hire Purchase Agreements, Conditional Sale agreements, PCPs and Fixed Sum Loan agreements. Occasionally they may be able to arrange other products in specific circumstances. If there is a particular type of credit agreement that suits your particular requirements then please let the dealer know and they will do there best to source that for you.

Your responsibilities – Disclosure

You do have a legal duty to tell us of all material information relating to the credit agreement. In particular, you must be sure of the accuracy and completeness of the information you give to us and the lender.

It is your responsibility to give complete and accurate information to lenders when you take out your credit agreement. You should check all documents that we send to you immediately to make sure they are correct. If there are any incorrect details on your documentation or if you are unsure about anything, please contact the dealer straight away.

Treating Customers Fairly

At Fynda.co.uk we insure that our dealers and finance companies are treated fairly – We ask each one to sign up to our code of conduct and we want to ensure that they treat you fairly before, during and after the sale. If you are dissatisfied with any aspect of there service or the product that you purchase please let us know and we will do our best to sort things out for you.

If you have a complaint about there credit related activities then please tell us without delay. You are also entitled to make a formal complaint by contacting the dealer. If they are not able to resolve your finance complaint to your satisfaction within 8 weeks, you can then refer your grievance to the Financial Ombudsman Service for adjudication. This procedure is free of charge and we will advise you how to go about making the referral.

If you need more assistance from the dealer because you are a vulnerable person or for any other reason such as your age or, a mental or physical infirmity, or learning disability please let the dealer know so that we can make reasonable adjustments for you.

Will you have to pay for our services?

There is no charge to you from us or the dealers in arranging finance for you. We may however receive a finance commission from the dealer or finance company who offers you credit or a car deal. The amount of finance commission varies. If you would like to know how much finance commission we will earn on your transaction then please ask our member of staff who will be pleased to provide you with this information. If the exact amount of finance commission is unknown, than an estimated amount will be provided to you on request.

In writing: Fynda.co.uk, Porthill Lodge, High St,Wolstanton,Newcastle-under-Lyme ST5 0EZ. We will acknowledge receipt of your complaint promptly within 7 working days. If our investigations take longer than this we will provide a full written response within 28 days, or explain the current position of your complaint and give you an indication of when we expect to provide our final response. If you cannot settle your complaint with us, you may be entitled to refer it to the Financial Ombudsman Service.

Data Protection

We are registered under the Data Protection Act and we aim to comply with the Data Protection principles at all times. All information about you will be treated as private and confidential and will be kept secure. We will only use and disclose the information we have about you in the normal course of arranging and administering your finance agreement. In addition, we have a wide range of insurance products and services available to us. We believe that these are some of the best and most appropriate in the marketplace. We would also like to be able to contact you so that we can further advise you of developments and details of new products which might be suited to you. We would stress that your information would only be used in this way to help us to provide a pro-active service to you. As we all know, time is precious and none of us want to be bombarded with information or products that are simply not relevant or which we do not require.

There may be times when Fynda.co.uk feels that a service or product may be of interest to you. In order to make you aware of these products or services we may wish to contact you so that you can make informed choices about these services or products. We may also use the information we hold about you to provide you with information on other products and services we can offer which we feel may be appropriate for you. If you do not wish to receive product or service information from us, please write to us on e-mail at the above address. Under the Data Protection Act 2018 you have rights of access to any personal information we hold about you in our records. If you have any queries or requests in this regard please contact us.

English Law

These Terms of Business are written in English and all communications about it will be in English.

These Terms of Business are governed and construed in accordance with English law. If any of the Terms of Business are held to be unenforceable or to be invalid either in part or in the whole, then the validity of the other terms will not be affected in any way.

These Terms of Business may be varied by us from time to time without prior notice
